Any references to “Sour Figs”, “we”, “us” or “our” means SOUR FIGS Limited., and any references to “you” or “your” means you in your capacity as a user of the Website.
IMPORTANT NOTICES
Please read these terms and conditions for the purchase of Sour Figs items on the Website (in the following referred to as the “Terms & Conditions”) before placing an order on the Website, as these will apply when you make a purchase from the Website.
By proceeding to place an order on the Website and accepting these Terms & Conditions, you agree to be bound by these Terms & Conditions. This applies whether you have read them or not. In case you do not understand parts of these Terms & Conditions, we recommend you contact our Customer Services before placing an order on the Website. You are not able to purchase any Sour Figs item(s) on the Website without accepting these Terms & Conditions. Please print a copy of these Terms & Conditions for your records.
Please note that these Terms & Conditions may be updated from time to time (e.g. to reflect changes in technology, our business models, our system capacity, or changes to relevant legislation and regulations). As a consequence, we ask you to accept our Terms & Conditions each time you place an order on the Website. You will not receive a notification of any such changes. The Terms & Conditions applicable to your purchase will be the Terms & Conditions accepted by you when you placed an order on the Website.
ENTERING INTO A CONTRACT
All advertisements on the Website is to be considered invitations to purchase Sour Figs items, and not offers to sell. Once a purchase has been concluded on the Website, such purchase is subject to approval and acceptance by Sour Figs. You will receive an order confirmation to the e-mail address provided by you once an order is accepted by Sour Figs. Once such order confirmation is received, a binding contract between you and Sour Figs is concluded (“Contract”). By placing an order on the Website and completing the check-out process, you represent and warrant that you are legally capable of signing binding contracts. Sour Figs may, in its sole discretion, accept a request by a customer for amendments or additions to the Contract.
ORDERING
Contracts can only be concluded on the website. We do not process orders made in emails, letters, or faxes. The purchase of Sour Figs items on the Website is subject to availability.
The Website is open twenty-four (24) hours a day but may be closed due to maintenance services. To the extent possible, we try to perform such maintenance services during the night.
An order placed on a public holiday or during the weekend will be processed on the following business day.
You must be at least 18 years old to purchase goods on the website and possess a valid credit card that is accepted by us.
We can only process your order if the delivery address is a residential address or a business address. We do not deliver to PO boxes.
If you do not understand parts of the Terms and Conditions, we recommend that you contact Customer Service before you make a purchase on the website.
AT WHAT POINT IN THE ORDERING PROCESS ARE YOU BOUND BY YOUR ORDER?
Before submitting the order, you have the option of changing the information provided, including delivery and billing information and/or payment information. Furthermore, you have the option of making changes to your order and removing items from your shopping basket. When you click “Complete payment” and the receipt appears on your screen, you are bound by the contract of purchase. Please read more under "Right of withdrawal". Please contact our Customer Service if you made a mistake while placing your order - they are ready to help you. You will receive an email confirming your order. After the conclusion of the Contract, the provisions on withdrawal apply. Please see the “Right of Withdrawal” section below.
Sour Figs ACCOUNT
When you make a purchase on the Website, you can choose to create an account or simply complete a single purchase, without creating an account. The personal information that you submit to Sour Figs in connection with the creation of your account is collected, stored, and processed in accordance with our Privacy Policy.
If you no longer wish to have an account with us, please contact our Customer Service in writing, at any time.
Please note that you are responsible for the security of your Sour Figs account and password. Sour Figs will not be liable for any damages and expenses arising out of or relating to the unauthorised use of your password.
When you click “Complete payment” and the receipt appears on your screen, you are bound by your order. You will shortly receive an email confirming your order, whereas a binding contract between you and Sour Figs is formed.
LANGUAGE OF THE CONTRACT
The language of the Contract is English.
MEASURES AGAINST FRAUD
In order to protect you and our other customers against fraud and maintain a high level of security for online purchases, we may carry out verification checks. The verification check may comprise the data that you send when ordering, including your address and payment information.
CANCELLATION OF CONTRACT
In case of circumstances which materially alter the economic aspects or the substance of the Contract or seriously interfere with the operation of Sour Figs or any of Sour Figs's suppliers, and also in case it should be subsequently proved impossible for Sour Figs to perform its obligations under the Contract, Sour Figs shall have the right to cancel the Contract in whole or in part.
You are not entitled to damages as a result of any such whole or partial cancellation, or for any other reason. Your sole remedy shall be the return of any payment made by you for Sour Figs items not delivered due to such cancellation.
We reserve the right to cancel the Contract in one of the following situations, without being liable for compensation or other costs:
- Your payment details are incorrect or cannot be verified;
- Your order is placed with the purpose of committing fraud etc. or placed in connection with a criminal offence or other unlawful activities;
- There is an inadvertent error on the Website, such as a payment error or the like; and/or
- We have reason to believe that you are not legally capable of entering legal contracts.
PROCESSING GUIDELINES
All orders are processed pending availability and credit card verification.
Orders placed after 2pm will be dispatched the next working day. Orders placed on weekends and bank holidays will be dispatched the next working day.
Orders placed on Friday after 2pm and through the weekend will begin processing on the following Monday.
Sour Figs will contact you if there are any issues with your order, or if additional identification is needed for credit card verification.
**During sale periods we cannot guarantee same-day dispatch for any orders.
DISCOUNTS
Please note that discounts are not eligible on sale items or in conjunction with any other offer.
INTERNATIONAL SHIPMENT
You may be subject to import duties and taxes once a shipment reaches your country. Additional customs clearance charges must be paid by you; Sour Figs has no control over these charges and cannot predict what they might be.
International orders may be subject to customs clearance procedures, which may cause delays beyond original delivery estimates. Customs policies vary widely from country to country; contact your local customs office for more information.
When ordering from Sour Figs you are considered the "importer of record" and must comply with all laws and regulations of the country in which you are receiving the goods.
REFUSED SHIPMENTS
If you choose to refuse your shipment, you will be responsible for any duties, taxes, and/or customs charges that are incurred on the package, and the cost of returning the package to our UK address. This amount will be deducted from your merchandise refund.
RETURNS & EXCHANGES
Returns are accepted on most merchandise within 14 days of receipt, for items that have not been worn, altered, or washed, without make-up marks and with all tags attached.
All returns received with make-up marks will be returned to the sender.
Cancelled items must be returned unused and in their original condition, from the original delivery country.
We offer exchanges for the same item, in an alternative size only, subject to availability. Should you wish to select an alternative style, please place a new order on our website and return the existing order for a refund. Original shipping charges are non-refundable. You will need to return the order to us by secure means to ensure it reaches us in good condition.
Please note during busy sale periods we are unable to offer exchanges.
• UK RETURNS
Returns within the UK can be sent free of charge. You can initiate your return by contacting us at info@sourfigs.com with your order number and your email receipt.
• INTERNATIONAL RETURNS
You can initiate your return by contacting us at info@sourfigs.com with your ORDER NUMBER and your email receipt.
Returns from outside of the UK need to be shipped at your own cost. We would recommend wrapping the order securely and lightly using a tracked service with your local post office (eg. USPS for US returns). You can return the order without the original box which will lower the costs significantly. We recommend that you obtain proof of posting or insure the return shipment as you are under a duty to take reasonable care of the goods and will be liable for damage or loss until we receive them at our warehouse.
For international returns please mark clearly "BRITISH RETURN GOODS - CLOTHING" as a description of contents on all paperwork provided by your chosen carrier. If this indication is not clearly stated, custom duty charges may be applied and the amount will be deducted from your merchandise refund. Use your original ORDER NUMBER as reference on your return shipping label and invoice.
You can cancel an order within the first hour. If the order status shows SHIPPED/COMPLETE, you will need to return the item within 14 days of receiving it.
In case of dispute, we recommend you retain the proof of sending when returning your order.
WHEN WILL MY CREDIT CARD BE REFUNDED FOR MY RETURN REQUEST?
Once merchandise has been received, your refund will be processed within 30 working days. You will be provided with an email notification once your refund has been processed.
Once you have received the confirmation of refund, you will need to follow up with your card issuer directly for any information for funds being cleared back to the original payment method.
DAMAGED OR DEFECTIVE GOODS
We are committed to selling only first-quality fashions and accessories. To that end, we employ several quality checks before an item is shipped. If you have received a damaged or defective item, please notify us by email at info@sourfigs.com within 14 days of receiving the order to be eligible for a refund.
After 14 days, we will attempt to repair or obtain a replacement, but we are unable to refund.
PAYMENT
We accept payments from all major card providers, and you can also process payments via PayPal or Klarna.
You must confirm that the credit/debit card that is being used is your own or that you have been specifically authorised by the owner of the credit/debit card to use it.
All credit/debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorise payment to Sour Figs, we will not be liable for any delay or non-delivery. We reserve the rights to ask for a proof of ID if the payment is suspicious or to cancel/reject any unusual orders.
To help ensure that your shopping experience is safe, simple, and secure, Sour Figs uses Secure Socket Layer (SSL) technology. This encrypts and protects the data you send to us over the internet.
If SSL is enabled then you will see a padlock at the top of your browser and you can click to find out information about the SSL digital certificate registration. You will also notice that when you look at the location (URL) field at the top of the browser you will see it begin with "HTTPS:" instead of the normal "HTTP:". This means that you are in a secure mode.
DISCLAIMER OF WARRANTIES
SOUR FIGS MAKES NO GUARANTEE OR WARRANTY, EXPRESS OR IMPLIED, OF THE Sour Figs ITEMS SOLD HEREUNDER OR OF THE MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF SUCH GOODS. EXCEPT AS OTHERWISE EXPRESSLY PROVIDED HEREIN, Sour Figs SHALL HAVE NO LIABILITY FOR DEFECTS IN MATERIAL OR WORKMANSHIP.
Sour Figs shall not be liable for normal manufacturing or finishing defects or for customary variations from quantities or specifications. The physical or chemical characteristics or qualities are not guaranteed unless and except to the extent specifically provided herein. All Sour Figs items are sold subject to the imperfections of natural and other if any, fibers.
FORCE MAJEURE, CASUALTY, AND AVAILABILITY OF RAW MATERIALS
Sour Figs shall not be liable for any delay in the delivery of any part of the Sour Figs items hereunder, and shall not be held responsible for any losses resulting if the fulfilment of any obligations, terms, or provisions of these Terms & Conditions or the Contract shall be delayed or prevented by revolutions or other disorders, wars, acts of enemies, strikes, fires, floods, acts of God, Government regulations, delay or inability to obtain labour, materials or goods through Sour Figs's usual and regular sources, insufficient orders, casualty, accident, economic downturns, or any other condition beyond the reasonable control of Sour Figs. In such event, Sour Figs may, at its discretion, without prior notice to you as a customer and contractual party, at any time and from time to time postpone the delivery dates under the Contract for a time which is reasonable under all the circumstances or make partial delivery or cancel all or any portion of this and any Contracts with you, and any such non-performance or cancellation shall not be considered a breach of the Contract or otherwise entitle you to any remedies.
LIMITATIONS OF SOUR FIGS’S LIABILITY
THE LIMIT OF LIABILITY OF SOUR FIGS FOR A BREACH OF ANY OF THE TERMS, CONDITIONS, OR PROVISIONS OF THESE TERMS & CONDITIONS AND/OR THE CONTRACT SHALL NOT EXCEED THE DIFFERENCE IN VALUE ON THE CONTRACT DATE OF DELIVERY BETWEEN THE SOUR FIGS ITEMS OR PERFORMANCE SPECIFIED AND THE SOUR FIGS ITEMS OR PERFORMANCE ACTUALLY DELIVERED, BUT IN NO EVENT SHALL SUCH VALUE EXCEED THE RETURN OF THE PURCHASE PRICE OF THE APPLICABLE SOUR FIGS ITEMS. IN NO INSTANCE SHALL YOU AS A CUSTOMER BE ENTITLED TO CLAIM CONSEQUENTIAL DAMAGES OR PROSPECTIVE PROFITS OR SPECIAL OR INDIRECT DAMAGES OR LOST REVENUE, PROFIT, OR GOODWILL, NOR SHALL SOUR FIGS BE LIABLE IN ANY INSTANCE FOR LOST PROFITS OR SPECIAL OR INDIRECT DAMAGES OR PROFITS ON CONTEMPLATED USE BY REASON OF BREACH OF CONTRACT OR WARRANTY BY SOUR FIGS, DEFECTIVE GOODS, DEFECTIVE OR LATE DELIVERY, OR NON-DELIVERY. IN NO EVENT SHALL SOUR FIGS BE LIABLE FOR ANY DAMAGES BY REASON OF YOUR, AS A CUSTOMER, INABILITY TO OBTAIN SUBSTITUTE GOODS IN THE OPEN MARKET.
RIGHTS OF SOUR FIGS
Sour Figs shall not be limited in its rights and remedies against you, as a customer and contractual party, for any cause whatsoever, but shall have such other rights and remedies as may be available to it under the applicable law or in equity.
THE COMPLETENESS OF THE CONTRACT
These Terms and Conditions constitute the complete terms of the contract between you, who complete the order on the website, and Sour Figs.
INVALIDITY
If one or more of the provisions in the Terms & Conditions are declared fully or partially invalid, the remaining provisions still apply.
ASSIGNMENT
Sour Figs is entitled to assign our rights and obligations under the Contract with you to third parties. The standard of the service you receive will not be impaired by the assignment. Sour Figs will notify you of such possible assignments. By accepting these Terms & Conditions you consent to any such future assignment. At the same time, you agree that from the time when we have given you notification of the assignment, your rights may be claimed only against the third party in question.
CHOICE OF LAW AND JURISDICTION
Our General Terms and, therefore, the Contracts entered into with you, shall be governed by and will be interpreted in accordance with the laws of England and Wales.
PRE-ORDER
Pre-ordering allows you to place an order for products that are not yet in stock or available for purchase. By pre-ordering, you can secure your purchase and be among the first to receive the item once it becomes available. Please note that pre-ordering does not mean the item will be shipped immediately. We advise you to check the estimated shipping dates provided on the product page or contact our customer service for further information. Please find general information about pre-order below:
- Your payment will be captured on the day the item is shipped.
- A pre-order item cannot be purchased together with an item in stock.
- You will receive a confirmation email when the order is shipped from the warehouse, and the payment will be captured.
- You will receive an email if your pre-order products are delayed.
- A pre-order can only be purchased with a credit card and/or gift card.
- Cancellation: You can cancel your pre-order by contacting our customer service.
- Return: Once you have received your pre-order, you can return the items just like a normal order.
